Please note, these terms and conditions are a legal agreement between you and JEUELS Pty Ltd., (“JEUELS,” “we”, “us”, or “our”), pursuant to which you will submit information to, rent and/or buy jewellery (a “Product(s)”) and receive related services from JEUELS via our website at www.jeuels.com.au (the “Website”).
BY CLICKING THE “JOIN NOW” BUTTON AS A FIRST TIME USER OR BY SUBMITTING AN ORDER FOR PRODUCTS AS A RETURNING USER, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT INCLUDING THE WEBSITE TERMS AND CONDITIONS OF USE AVAILABLE AT Terms & Conditions (link here)AND THE PRIVACY POLICY AVAILABLE AT Privacy Policy (link here), AS SUCH TERMS MAY CHANGE FROM TIME TO TIME. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, DO NOT CLICK THE “JOIN NOW” BUTTON OR SUBMIT YOUR PRODUCT ORDER AND YOU WILL NOT BE PERMITTED TO RENT OR, IF APPLICABLE, PURCHASE THE PRODUCTS. WE RESERVE THE RIGHT TO CHANGE THE TERMS OF THIS RENTAL AGREEMENT IN THE FUTURE AND ANY CHANGES WILL APPLY TO THE RENTAL OR PURCHASE OF ANY PRODUCTS AFTER THE DATE OF SUCH CHANGE.
The following conditions apply to the rental of any Product.
RENTAL TERMS – COLLECTIONS. With the exception of the “Bridal” and “Prized” categories ( considered “Deluxe Collections”), all Product(s) listed at JEUELS are available to rent at no extra cost as they are accommodated by the monthly membership fee. The membership tier determines how many Product(s) a member can rent at one time and members can rent new Product(s) so long as they return previously rented Product(s) in condition that was sent to the member, without excessive damage as per the nominated shipping procedure. Members can rent Product(s) for any length of time so long as their monthly membership fee is successfully debited from their nominated credit card and no monetary amount is owed to JEUELS.
RENTAL TERMS – PRIZED & BRIDAL SECTION. Product(s) within the “Bridal” and “Prized” section (“Deluxe Collection”) are available to rent via an additional daily fee separate to the monthly membership fee and are available to be booked in advance for specific dates of interest. As members nominate the length of days in which they seek to rent the Product(s), it is the responsibility of the member to return Product(s) in a timely manner on or before the last prepaid day of hire or else they will be subject to late fees as per below clause.
RETURN OF THE PRODUCTS & TIME EXTENSIONS. You agree to return the Products to JEUELS in the exclusive packaging supplied and via the Return label of the agreed shipping partner. Products from the “Collections” section can be returned after any length of time. Products from the “Prized / Bridal” section must be returned on or before the return date identified in the prepaid online invoice for your order. You may extend your order for a Product from the “Prized / Bridal” section through your Account settings; provided that the Product is available and not already booked by another member, and that you pay online upfront for the additional fees associated with additional days of hire. A package must be scanned by the postage service to be considered mailed ‘that day’. We are not responsible for any personal or other items left in the Product(s) or which are returned to JEUELS in the Return Packaging. If you believe you have accidentally or otherwise sent us any such items, please contact customer service as soon as possible at contact@jeuels.com.au.(link here) Our staff may assist in attempting to locate such items at a customer’s request, but are not obligated to and assume no liability for doing so.
LATE FEES – PRIZED & BRIDAL SECTION. If you return Product(s) from the “Prized / Bridal” section late, a late fee of fifty dollars ($50.00) will be charged per day of delay to the nominated payment card on your account. You agree to pay such late fees, up to an amount not to exceed 100% of the Retail Value plus applicable taxes and Rental Fee. The late fee is payable for each order of Products that is not returned when due, not for each Product that is the subject of the order that is late. If you have not returned a Product within seven (7) days after the return date for the Product, your late return will be considered a non-return and JEUELS will charge your payment card the maximum late fee set forth in this Section, less any late fees that you have already paid, plus applicable tax.
CANCELLATION POLICY.
Cancellations are subject to the following:
a. Cancellations thirty (30) or more days prior to the delivery date receive a full refund issued to the payment card you used to complete order.
b. Cancellations fourteen (14) days prior to the delivery date receive a store credit for the hire fee.
c. Cancellations less than fourteen (14) days prior to the delivery date receive a store credit for the Hire Fee, minus a cancellation fee of $15.00.
PAYMENT OF 100% RETAIL VALUE. JEUELS will not charge you for more than an amount equal to 100% of the Retail Value plus applicable taxes and the Rental Fee. If you pay JEUELS an amount equal to 100% of the Retail Value plus applicable taxes and the Rental Fee, and you still possess the Product, the Product is yours to keep, though on an “AS IS” basis without warranty of any kind.
LOST PACKAGING & RETURN LABEL. If you lose the Return Label, check the Order History within your Account for a digital copy that can be printed at your own convenience. If you lose, damage or fail to return the JEUELS packaging, you will be charged $50. If you still possess the JEUELS carrying case, it is yours to keep, though on an “AS IS” basis without warranty of any kind.
The following additional conditions apply to the sale of any Product.
PRODUCT(S) ARE USED; ALL SALES ARE FINAL AND “AS IS.” You acknowledge and agree that only those Product(s) designated by us on the Site as available for purchase are eligible for purchase by you. THE PRODUCT(S) FOR SALE HAVE BEEN PREVIOUSLY RENTED BY OTHER CUSTOMERS AND ARE NOT NEW. JEUELS will professionally clean and inspect the Product(s) before they are delivered to you. However, all Product(s) are sold on an “as is” basis, without any warranty whatsoever, and all Product sales are final.
PURCHASE PRICE. The purchase price for the Product(s) will encompass taxes and delivery charges listed on the Site. Purchase Price is as listed on the JEUELS website at the time of purchase, and is subject to change. JEUELS reserves the right to alter Purchase Price, discount, or availability of any particular item at its discretion and without notice. Upon your purchase order for a Product, you hereby authorise JEUELS to charge your payment card for the Purchase Price. We will charge your payment card the amount of the Purchase Price immediately upon your purchase order. Purchase orders are final and cannot be cancelled.
